Female Workers Win £30 million for Discrimination in Payment of Bonus

The Birmingham City Council had to face protests from more than 5,000 female workers over their discriminatory bonus scheme. Prior to 2007, the bonus scheme allowed the male workers, who worked as refuse collectors, street cleaners and road-workers, to earn 159% of their salary as bonus. On the other hand, female workers, who worked mostly as cleaners, cooks and care assistants, were given a much lower bonus.
A male worker working as refuse collector got up to £51,000 as bonus while female workers in the same category got only around £12,000 as bonus. Female workers protested against the bonus scheme under the aegis of GMB and Unison.
The scheme was removed in 2007 and was replaced with a better system that was in accordance with the Equal Opportunity Commission equality guidelines. However, according to the workers and unions, this still left some people underpaid by £18,000 and as a result, more than 3,000 workers went on strike in 2008.
In the case before the Employment Tribunal, around 5,000 female workers successfully challenged the bonus scheme. The council argued that it thought that refuse collectors should get a special treatment. However, the tribunal did not accept the argument stating there is no reason for the same as everyone is entitled for bonus for doing the same work.
The tribunal accepted that there was no justified reason for the difference in payment of the bonus. Currently, the tribunal is deciding the amount of award, which is estimated to be at least £30 million.
The huge payout is a great victory for female workers who have been through years of discrimination in compensation.
